Introduction
Welcome to PlungeWorx. By signing up for a membership or using our services, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully as they govern your access to and use of our facilities and services, including cold plunging, infrared sauna, and red light therapy.

1. Services Provided
PlungeWorx offers wellness services, including:

• Cold & Hot Plunging
• Infrared Sauna
• Red Light Therapy

Our services are designed for health and relaxation purposes. By using any of these services, you acknowledge and agree to these Terms & Conditions.

2. Membership Packages

2.1. Wellness Enthusiast Package

• Access to unlimited Cold Plunges, Infrared Sauna, and Red Light Therapy sessions.
• 15% discount on retail items.
• $149.99 per month (auto-renewal unless canceled with 60-day notice).

2.2. Student/Military Wellness Rate

• Same benefits as the Wellness Enthusiast Package for students with valid ID.
• $109.49 per month (auto-renewal unless canceled with 60-day notice).

2.3. Flexible Wellness Package

• Access to 10 full sessions per month.
• $79.99 per month.
• $63.99 with a valid Student/Military ID

2.4. Corporate & Sports Team Wellness Packages
Customizable packages for businesses or sports teams. Contact us for pricing and details. A message feature is available on our website for inquiries.

2.5. Single Session
$19.99 per session.

3. Pre-Sale Package
Lock in a $99/month membership for the first year with a one-time $15 enrollment fee. Offer available until the first day of business operations. Monthly payments begin on the first day of business operations.

4. Payment Terms

4.1. Billing and Auto-Renewal
Membership payments are automatically charged to the card on file on a monthly basis. Auto-renewal applies unless canceled with a 30-day written notice. Monthly memberships will renew monthly until canceled.

4.2. Cancellation Policy
Members may cancel their membership with a 30-day written notice. If cancellation occurs within the first 12 months, a $75 cancellation fee will be assessed. No cancellation fee will apply after the first 12 months have passed.

5. Refund Policy
No refunds will be provided once a service has been used. Refunds are only available before using any of the services.

6. Facility Rules and Regulations
To ensure the safety and enjoyment of all members, the following rules must be adhered to while using PlungeWorx facilities:

• Use PlungeWorx towels and shoes/slippers at all times.
• Rinse off in the showers before entering the tubs.
• No jumping into tubs, splashing, or running.
• No walking around the facility while wet.
• No smoking (including e-cigarettes or vapes) is allowed.
• No loud music.
• Sessions are limited to a maximum of 2 hours.

7. Age Restrictions
Individuals aged 16 or older may use the facilities without supervision. Individuals under the age of 16 must have adult supervision at all times.

8. Health Conditions and Warnings

8.1. Pregnancy and Cold Plunge/Infrared Sauna Disclaimer
Participation in cold plunge activities and the use of infrared saunas during pregnancy should only occur with prior approval from a qualified healthcare provider. Both activities may pose risks, including but not limited to reduced circulation, changes in core body temperature, and dehydration, which could affect both the pregnant individual and the fetus. By participating in cold plunge activities and using infrared saunas while pregnant, the participant acknowledges that they have consulted with their healthcare provider and assume full responsibility for any risks. PlungeWorx is not liable for any adverse effects or injuries related to participation in cold plunge activities or infrared sauna use during pregnancy.

8.2. Cold Plunging
Cold plunging can be dangerous for individuals with certain medical conditions. Please consult your doctor before using cold plunge services if you have:

• Cardiovascular Issues: Individuals with heart conditions, high blood pressure, or circulatory problems should avoid cold plunging unless consulted with your physician, as the sudden exposure to cold can cause a rapid increase in heart rate and blood pressure.
• Raynaud’s disease
• Respiratory Conditions: Those with asthma, chronic obstructive pulmonary disease (COPD), or other respiratory issues may experience difficulty breathing due to cold exposure
• Severe Allergies: Some individuals may have heightened sensitivities to cold, which could result in allergic reactions or extreme discomfort.
• Diabetes.
• Any condition that may be aggravated by sudden changes in temperature or cold exposure.

8.3. Hypothermia Risk
Cold-water exposure can cause hypothermia. Plunge sessions should be limited to no more than 10 minutes. For water temperatures below 40°F, sessions should not exceed 5 minutes.

8.4. Infrared Sauna Use
Infrared saunas are not suitable for individuals with:

• Kidney problems, inflammation, or acute infections.
• Heart failure or cardiovascular disease.
  Pregnant women or individuals with heat-sensitive conditions should avoid infrared saunas unless they have consulted with a healthcare provider.

8.5. Red Light Therapy
Red light therapy is generally considered safe. However, individuals who are pregnant, have photosensitive conditions, or are on photosensitizing medications should consult their doctor before use.

9. Limitation of Liability
By using PlungeWorx facilities, you assume all risks associated with cold plunging, sauna use, and red light therapy. You agree that PlungeWorx, its owners, staff, agents, and affiliates shall not be liable for:

• Injuries, illness, death, or health conditions arising from the use of the facilities.
• Property loss or damage, including loss or theft of personal items.
  This waiver applies regardless of whether the injury, illness, or property loss was caused in whole or in part by the negligence of PlungeWorx, its staff, or equipment.

10. Medical Conditions and Physician Approval
If you have any chronic medical conditions, including but not limited to cardiovascular disease, high blood pressure, or heat sensitivity, you must provide written medical approval from your physician to use PlungeWorx services. If at any time during your use of the facilities you experience nausea, dizziness, or severe fatigue, you must discontinue use immediately and seek medical attention.

11. Assumption of Risk
Members acknowledge that using cold plunging, infrared sauna, and red light therapy services carries inherent risks. By participating in these services, you confirm that:

• You are in good physical condition or have consulted with a physician regarding your ability to safely engage in these activities.
• You voluntarily assume all risks associated with these services and release PlungeWorx from any liability for injury or damage resulting from participation.

12. Handling of Customer Data
PlungeWorx respects your privacy and is committed to protecting your personal information. We will never sell or distribute your personal data to third parties. Customer information will only be used for business purposes, such as processing payments, managing memberships, and communicating with members.

13. Amendments and Changes
PlungeWorx reserves the right to modify these Terms & Conditions at any time. Changes will be posted on our website, and members will be notified via email. Continued use of the facilities after changes are posted constitutes acceptance of the new terms.

14. Booking and Reservation Policy
Our business operates on a membership basis, so there are no booking options required. Members can use the facility at their convenience. Unlimited membership holders may use the facility multiple times a day if they wish.

15.1. Voluntary Membership Suspension
Members may request to suspend their membership for up to 2 months each year. Written notice is required to initiate the suspension. During this period, the membership will be temporarily frozen, and no charges will apply.

18. Guest Passes
18.1. Unlimited Package Members
Unlimited membership holders may bring one guest for a fee of $5. All guests must sign the required waivers before using any facility. Additional guests beyond the first will incur a fee of $10 per guest.

18.2. Non-Unlimited Package Members
Members with non-unlimited packages can bring one guest for a fee of $10. All guests must sign the required waivers before using any facility.

19. Referral Program
Refer 10 friends and receive a free membership for a year

20. Equipment Use and Responsibility
Members are responsible for using all equipment and facilities in accordance with the posted instructions and guidelines. Misuse of equipment may result in suspension or termination of membership. Members agree to:

• Report any damaged or malfunctioning equipment immediately to PlungeWorx staff.
• Refrain from using faulty or broken equipment until the issue has been resolved by staff.

21. Facility Hours and Holiday Closures
21.1. Facility Hours
PlungeWorx is open from 5 AM to 8 PM every week day, and 9am-3pm on weekends. Any changes to facility hours will be communicated via email or posted on the website.

21.2. Holiday Closures
PlungeWorx will be closed on certain public holidays. Members will be informed of these closures through email or website updates.

22. Code of Conduct
To maintain a positive and respectful environment for all, members must adhere to the following Code of Conduct:

• Treat all staff, members, and guests with respect and courtesy.
• Maintain cleanliness in all areas and avoid disruptive behavior.
• Respect the privacy of others by refraining from taking photographs or videos inside the facility without permission.

PlungeWorx reserves the right to remove individuals from the premises if their behavior disrupts the peace or comfort of others.

23. Dispute Resolution
Any disputes arising from or related to these Terms & Conditions shall be resolved as follows:
23.1. Mediation
In the event of a dispute, both parties agree to first attempt resolution through mediation. A neutral mediator will be appointed to facilitate negotiations.

23.2. Arbitration
If mediation fails, both parties agree to submit the dispute to binding arbitration under the rules of American Arbitration Association. The arbitrator’s decision will be final and binding.

24. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.

25. Severability
If any provision of these Terms & Conditions is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

26. Waiver of Rights
PlungeWorx’s failure to enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision.

27. Photography and Marketing
27.1. Marketing and Promotions
By using the PlungeWorx facility, you agree that PlungeWorx may take photographs or videos for marketing and promotional purposes. If you do not wish to be photographed or filmed, please notify the staff prior to your session.

27.2. Opt-Out
You may opt-out of having your image used in promotional materials by contacting us at wellness@plungeworx.com. We will make reasonable efforts to exclude you from future marketing campaigns.

28. Changes to Services
PlungeWorx reserves the right to modify or discontinue any service at any time without prior notice. In the event of a material change to a service, affected members will be notified in advance and offered alternative options or the right to cancel their membership without penalty.

29. Compliance with Local Regulations
PlungeWorx ensures that all operations and services comply with state and local health regulations. This includes, but is not limited to, sanitation protocols, temperature controls for cold plunges, and safety measures for infrared sauna and red light therapy.
